Our online software-as-service platform https://leadbay.app/ including any related APIs provided by leadbay, together with all related applications are collectively referred to as the “Platform”.

  • Access or use any of our applications or our leadbay Platform,

  • Register and/or attend any virtual or in-person events hosted or attended by us,

Definitions

For the purposes of this Privacy Policy:


Account means a unique account created for You to access our Service or parts of our Service.


Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.


Application refers to leadbay, the software program provided by the Company.


Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Leadbay SAS, La Guignardière 41290 La Bosse, Vievy-le-rayé.


Country refers to: France


Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.


Personal Data is any information that relates to an identified or identifiable individual.

Service refers to the Application.


Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.


Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.

Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

It does not cover the personal information leadbay collects, uses and discloses on behalf of its Customer (“Customer Personal Data”) in connection with leadbay Platform and we invite you to contact the relevant company or organization if you have any questions about their privacy practices.


This means that leadbay is the Data Processor for such Personal Data processed on the Customer’s behalf and under its instructions.


Leadbay will process Customer Personal Data to provide the Platform and other limited purposes as outlined in this section below. In those limited purposes, leadbay is responsible for processing your Personal Data and is the Data Controller.

Types of Data Collected

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

Digital behavioral data:Web page interactions (clicks, browsing, zooms and other interactions), referring web page/source through which you accessed the Sites, and statistics associated with the interaction between device or browser and the Sites.

Agreement and Transaction Data: agreements, orders, purchases, payment status, and invoices; and your other interactions with us related to transactions, such as service requests and messaging with our customer service.


Payment Data: Card data, Corporate bank account information of customers

“Marketing Communications” means when we contact you about leadbay’s Platform, events, or business.


“Internal Development” means when leadbay improves and better develops the Platform including testing, research, reporting, benchmarking, machine learning, performance analyses, predictions and trend analysis in order to support our business decision-making, to analyze our Customers’ engagement with our Platform,, to assess the quality of our Platform and to consider our Customers’ feedback and needs. For our Internal Development, we process de-identified and aggregated data to the extent possible. We may use samples of real data, for example, to test the quality and the performance of our platform. If you do not wish to be part of this test, you can let us know at any time. We may process all of the above Personal Data to comply with our various legal obligations (“Legal Obligations”). Our Legal Obligations include:

  • Complying with applicable laws, regulatory requirements, and our internal policies

  • Preventing, mitigating, and investigating data protection and security incidents, fraud, errors, or any illegal or prohibited activity relating to leadbay’s Platform

  • Protecting the rights, safety, property, or operations of leadbay, you, or others

  • Responding to regulator, law enforcement authorities or other government official/agency request or your data protection requests

  • Enforcing agreements with you, resolving disputes, and defending a legal claim


Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.


When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.


The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

  • Visitor Digital Behavior analytics and User usage monitoring and analytics, 24 months

  • Support, maintenance, and account management, For the agreement duration with Customers and then archived for 7 years

  • Delivering the Platform, providing customer service and managing payments, contracts and transactions and otherwise meeting our contractual requirements, For the agreement duration with Customers and then archived for 7 years

  • Fulfilling your request related to the Platform and communicating with you in contract-related matters, For the agreement duration with Customers and then archived for 7 years

  • Marketing Communications, 2 years from the last contact, or 30 days after a deletion request,

  • Organizing, managing, and facilitating access to our events, For the time necessary to achieve this purpose

  • Internal Development, Up to 24 months

  • Legal Obligations, As required by applicable law or regulation except: in case of a dispute, until the settlement of the dispute; in case of a legal claim, for the duration of the proceedings and until the ordinary and extraordinary means of recourse are exhausted with regard to the decision rendered


Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.


Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

Some of our service providers may perform actions on our behalf, under our instructions, in accordance with our agreement and in compliance with appropriate technical and organizational security measures to protect your Personal Data.

Leadbay seeks to conclude data processing agreements with its service providers to ensure that your personal data is used, stored and transferred securely and in accordance with the applicable laws.


  • Our affiliates;

We may share, disclose and transfer your Personal Data with our current) and future subsidiaries and affiliated companies for all purposes mentioned in Section 4 above.


  • Third Parties involved in a corporate transaction with us.


  • We may also disclose or transfer personal data to fulfill legal obligations or when a legal authority requires a disclosure. We may also disclose personal data if we are a party of a business sale, such as a merger or an acquisition.


  • Third parties you connect to leadbay

Google: We access your Google User Data only to facilitate and enhance the functions of our application. Specifically, we synchronize your Google Docs, Google Slides, pdfs, and plain text files (files with the “.txt” extension) that are within the folders you select when connecting your Google Drive account to leadbay. You can change this selection at any time or request us to delete all your data.

The sole purpose of this data is to allow you to use your Google User Data on the leadbay Platform. leadbay will not use this data for any other purpose like advertising or marketing.

Delete Your Personal Data

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.

Our Service may give You the ability to delete certain information about You from within the Service.


You may update, amend, or delete Your information at any time by signing in to Your Account, if you have one, and visiting the account settings section that allows you to manage Your personal information. You may also contact Us to request access to, correct, or delete any personal information that You have provided to Us.


Please note, however, that We may need to retain certain information when we have a legal obligation or lawful basis to do so.


Disclosure of Your Personal Data


Business Transactions
